On the one hand, the forest provides economical growth, but it also brings the natural demage (environmental ecosystem) on the other hand. The legal norms become a border and a sign of legal subject flexibility at once for forest exploitation. According to Gustav Radburch, the purposes of law are fairness, certainty and usefulness; it will become the hope to create environmental management which has environmentally sound based on Law No. 32 of 2009 on the Protection and Environmental Management. This article uses a normative legal research based on legal system components including the structure, substance and legal culture. There are some rights and obligations in environmental management; the right to live in healty and good environment, and obligation to keep the environment as well as possible. Justice in environmental management can be actualized if rights and obligations are run inequilibrium. Whereas, the legal certainty lies in the rule of law that become the reference of legal subject to exploit the forest resources. The legal certainty can be run effectively if it supported by good law enforcement. The legal benefit is achieved when the domminant legal subject perceived to benefit happiness. Fairness, certainty and benefits provide significant functions to maintain the environmental management with environmentally sound. But it can not be implemented simultaneously because of different tasks and functions.

Already, salinity intrusion, increasing cyclones and anomalies in rainfall, and temperature, are causing many social … The Bengal delta coast harboring the famous Sundarban mangroves is extremely vulnerable to climate change. Already, salinity intrusion, increasing cyclones and anomalies in rainfall, and temperature, are causing many social and livelihood problems. However, our knowledge on the diversified climate change impacts on Sundarban ecosystems services, providing immense benefits, including foods, shelters, livelihood, and health amenities, is very limited. Therefore, this article has systematically reviewed the major functional aspects, and highlights on biodiversity, ecosystem dynamics, and services of the Sunderban mangroves, with respect to variations in climatic factors. The mangrove ecosystems are highly productive in terms of forest biomass, and nutrient contribution, especially through detritus-based food webs, to support rich biodiversity in the wetlands and adjacent estuaries. Sundarban mangroves also play vital role in atmospheric CO2 sequestration, sediment trapping and nutrient recycling. Sea level rise will engulf a huge portion of the mangroves, while the associated salinity increase is posing immense threats to biodiversity and economic losses. Climate-mediated changes in riverine discharge, tides, temperature, rainfall and evaporation will determine the wetland nutrient variations, influencing the physiological and ecological processes, thus biodiversity and productivity of Sundarban mangroves. Hydrological changes in wetland ecosystems through increased salinity and cyclones will lower the food security, and also induce human vulnerabilities to waterborne diseases. Scientific investigations producing high resolution data to identify Sundarban?s multidimensional vulnerabilities to various climatic regimes are essential. Sustainable plans and actions are required integrating conservation and climate change adaptation strategies, including promotion of alternative livelihoods. Thus, interdisciplinary approaches are required to address the future climatic disasters, and better protection of invaluable ecosystem services of the Sunderban mangroves.Asian J. Med. Biol. Res. Hasil penelitian Penegakan Hukum Lingkungan dalam kaitannya dengan Hukum Pidana yaitu terkait Subtansi Hukum pada Pasal 69 ayat (1) huruf H Undang-undang Nomor 32 tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup memuat tentang larangan melakukan pembukaan lahan dengan cara membakar dan tindakan terhadap pelaku untuk menegakan hukum dan Penegakan hukum lingkungan terhadap pertumbuhan ekonomi di Indonesia terpengaruhi oleh 3 (tiga) Aspek yaitu Produk hukum, Sistem Hukum dan Resiko politik yang selalu berubah. Kesimpulan penegakan hukum dilakukan berdasarkan peraturan perundang-undangan yang berlaku dan faktor-faktor yang mempengaruhi pertumbuhan ekonomi yang sangat perlu di perhatikan adalah komitmen pejabat tertinggi yang bertangung jawab terhadap maju mundurnya suatu negara. Rekomendasi penegakan hukum harus dilakukan sesuai peraturan perundang-undangan tanpa melihat latar belakang perusahaan atau individu sehingga kepastian hukum untuk berinvestasi terjamin dan reformulasi Pasal 69 ayat (1) huruf H Undang-undang Nomor 32 tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup.Kata kunci : Penegakan Hukum, Pertumbuhan Ekonomi dan Pengaruhnya.

Penelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan dan metode Penyuluhan Hukum lansung dalam meningkatkan kesadaran hukum masyarakat serta pengaruh Penyuluhan Hukum terhadap kesadaran hukum masyarakat. Metode penelitian menggunakan pendekatan kualitatif yang ditinjau dari segi penerapan peraturan. Hasil penelitian menunjukan bahwa Pelaksanaan Penyuluhan Hukum lansung pada masyarakat selama ini sangat minim dilakukan oleh instansi yang terkait dan belum membawa pengaruh yang signifikan bagi peningkatan kesadaran hukum masyarakat karena terkendala dengan permasalahan antara lain: terbatasnya sarana dan prasarana, anggaran yang tersedia kurang memadai dan terbatasnya kemampuan SDM. Saran Frekuensi pelaksanaan penyuluhan hukum sebaiknya volumenya ditingkatkan dilakukan secara berkesinambungan, baik tempat maupun materinya, perlu peningkatan kualitas maupun kuatintas SDM tenaga fungsional Penyuluh Hukum agar lebih profesional melalui uji kompetensi, perlu dilakukan Penyuluhan Hukum bersama dan disinergikan antar intansi. Metode penyuluhan hukum secara lansung melalui ceramah, hendaknya dilakukan lebih menarik masyarakat.

Aturan hukum dibuat untuk mengantisipasi hal tersebut namun aturan yang ada rupanya tidak membuat tindak pidana tersebut semakin berkurang tetapi mengalami peningkatan. Penelitian ini bertujuan untuk: pertama, mengetahui penegakan hukum terhadap tindak pidana penipuan berbasis e-commerce; dan kedua, mengetahui faktor-faktor penghambat dalam penegakan hukum pidana terhadap tindak pidana penipuan berbasis e-commerce. Penelitian ini dilakukan dengan metode yuridis normatif melalui studi kepustakaan dengan menelaah data sekunder meliputi peraturan perundang-undangan, hasil penelitian, jurnal ilmiah dan referensi. Hasil penelitian menggambarkan bahwa tindak pidana penipuan berbasis e-commerce pada prinisipnya sama dengan penipuan dengan cara konvensional namun yang menjadi perbedaan terletak pada alat bukti atau sarana perbuatannya yakni menggunakan sistem elektronik (komputer, internet, perangkat telekomunikasi). Oleh karenanya penegakan hukum mengenai tindak pidana penipuan ini masih dapat diakomodir oleh Kitab Undang-Undang Hukum Pidana dan Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Selanjutnya, Hambatan dalam penegakan hukum terhadap tindak pidana penipuan berbasis Transaksi elektronik masih dipengaruhi oleh lima faktor yaitu faktor hukum, faktor penegak hukum, faktor sarana atau fasilitas yang mendukung penegakan hukum, faktor masyarakat dan faktor kebudayaan.

Artikel ini bertujuan untuk mengkaji peran serta masyarakat dalam upaya pencegahan dan pemberantasan Tindak Pidana Korupsi. Metode penelitian dalam artikel ini adalah penelitian hukum normatif yang bersifat preskriptif analitis, melalui conceptual approach, statute approach, dan case approach. Hasil penelitian menyimpulkan bahwa : pertama, peran masyarakat harus turut serta dalam upaya pencegahan dan pemberantasan tindak pidana korupsi dengan alasan bahwa masyarakat sebagai korban dan masyarakat sebagai komponen negara. Kedua, bentuk peran serta masyarakat dalam upaya pencegahan dan pemberantasan tindak pidana koruosi adalah dengan mempedomani ketentuan peran serta masyasrakat sebagaimana telah diatur pada perundang-undnagan dengan melakukan kontrol sosial yang direncanakan maupun yang tidak direncanakan untuk mendidik, mengajak atau bahkan memaksa para warga masyarakat agar menyesuaikan diri dengan kebiasaan dan nilai kehidupan masyarakat yang bersangkutan.

Penerapan prinsip keadilan, didasarkan pada “ daya laku hukum” dan “ kesamaan di hadapan hukum”. Prinsip kepastian hukum, ditempuh melalui: (i) penormaan yang jelas dan tegas mengenai keharusan dan larangan; (ii) transparansi hukum yang menghindarkan masyarakat dari kebingungan normatif; dan (iii) kesinambungan tertib hukum yang memberi acuan bagi perilaku di masa mendatang. Adapun prinsip kemanfaatan didasarkan pada kemampuan hukum sebagai instrumen sosial untuk mengintegrasikan agregasi kepentingan sosial agar tidak saling berbenturan, dan sebaliknya terjadi keteraturan.</p>

The development of the AUPB principle arrangement had found an increasingly strong momentum when the Government Administration Act was passed in 2014. As a result of the adoption of the concept of the welfare state, the state must fulfill the welfare of the community, one of which is through public services. With the AAUPB, it is expected that the government as a public service provider, can accept the AAUPB as a legal norm that must be used as the basis by the civil service provider in carrying out its authority, as well as a means for citizens to sue deviant public service providers. Abstrak Asas-asas umum pemerintahan yang baik (selanjutnya disebut AAUPB) lahir dari praktik penyelenggaraan negara dan pemerintahan sehingga bukan produk formal suatu lembaga negara seperti undang-undang. Asas-asas umum pemerintahan yang baik dapat dipahami sebagai asas-asas umum yang dijadikan sebagai dasar dan tata cara dalam penyelenggaraan pemerintahan yang layak, yang dengan cara demikian penyelenggaraan pemerintahan itu menjadi baik, sopan, adil, dan terhormat, bebas dari kezaliman, pelanggaran peraturan, tindakan penyalahgunaan wewenang dan tindakan sewenang-wenang. Sejarah perkembangan AUPB di Indonesia dapat dilihat dari perkembangan prinsip AUPB dalam berbagai peraturan perundang-undangan, praktik penerapan AUPB dalam putusan pengadilan atau yurisprudensi serta doktrin. Perkembangan pengaturan prinsip AUPB menemukan momentumnya yang semakin kuat, tatkala UU Administrasi Pemerintahan disahkan pada tahun 2014. Sebagai akibat dari dianutnya konsepsi welfare state maka negara memiliki kewajiban untuk memenuhi kesejahteraan masyarakat salah satunya melalui pelayanan publik. Dengan adanya AAUPB diharapkan pemerintah sebagai pemberi pelayanan publik dapat menerima AAUPB sebagai norma hukum yang harus dijadikan dasar oleh penyelenggara pelayanan publik dalam menjalankan kewenangannya, sekaligus sarana bagi warga negara untuk menggugat penyelenggara pelayanan publik yang menyimpang. Indonesia perlu menerapkan omnibus law sebagai jawaban atas permasalahan-permasalahan yang menghambat investasi di Indonesia. Omnibus Law secara sederhana dapat dimaknai sebagai satu undang-undang yang bisa mengubah beberapa undang-undang sekaligus. Terdapat tiga keadaan untuk mempraktekkan omnibus law, yakni undang-undang yang akan diubah berkaitan secara langsung, undang-undang yang akan diubah tidak berkaitan secara langsung, dan undang-undang yang akan diubah tidak berkaitan tetapi dalam praktek bersinggungan. Penerapan omnibus law di Filipina, Amerika Serikat dan Turki dapat menjadi perbandingan untuk diterapkan omnibus law yang berbudaya hukum Indonesia. Omnibus law sejatinya adalah teknik dalam penyusunan undang-undang yang bertujuan untuk mewujudkan efisiensi dan efektivitas sehingga sangat mungkin diterapkan di Indonesia. Untuk mewujudkannya diperlukan pemahaman tentang omnibus law dan komitmen politik yang kuat dari DPR maupun Pemerintah Indonesia.

Penelitian ini bertujuan untuk mengetahui tentang apa urgensi pelibatan mahkamah konstitusi dalam perubahan Undang Undang Dasar Negara Republik Indonesia Tahun 1945, dan bagaimana prospektif pelibatan mahkamah konstitusi dalam perubahan undang undang dasar Negara Republik Indonesia Tahun 1945. Penelitian ini mengunakan Jenis penelitian normatif. Hasil penelitian ini menunjukan bahwa Urgensi pelibatan MK dalam perubahan Undang Undang Dasar di dasarkan pada beberapa hal, antara lain: Pertama, terdapat banyak kelemahan dalam amandemen pertama sampai dengan amandemen ke-empat; Kedua, Eksistensi MPR sebagai lembaga politik; ketiga, Pelakasanaan prinsip Checks and Balance System; Keempat, Perwujudan MK sebagai The Guardian Of Consitution. This study uses a type of normative research and several approaches, namely; law approach (statue approach), comparative approach, and conceptual approach. The results of this study indicate that the urgency of involving the Constitutional Court in amending the Constitution is based on several things, including: First, the weaknesses in the first amendment to the fourth amendment; Second, the existence of the MPR as a political institution; third, the implementation of the Checks and Balance System principle; Fourth, the realization of the Constitutional Court as the Guardian of Constitution. The prospective involvement of the Constitutional Court in the amendment to the 1945 Constitution of the Republic of Indonesia is to emphasize the political goodwill of the MPR to develop a mechanism for amending the 1945 Constitution of the Republic of Indonesia by involving the Constitutional Court as a state institution which provides a review of changes made by the constitution before obtaining approval from the MPR to be determined as a result of the amendment to the new 1945 Constitution. UU Omnibus tersebut akan menggantikan sebagian atau seluruhnya dari undang - undang yang saat ini telah ada dan terkait dengan klaster dari uu omnibus tersebut. Kendala yang dihadapi dalam pembentukan uu omnibus adalah masih belum pahamnya anggota DPR dalam menyusun uu omnibus sehingga perlu adanya perhatian khusus dan padatnya agenda dari para anggota DPR dapat menjadi faktor penghambat lambannya pembentukan uu omnibus.

Metode penelitian yang digunakan dalam penulisan ini adalah metode penelitian normatif, metode ini dipilih karena obyek kajian penelitian adalah mengenai asas dan prinsip hukum, kaidah hukum, teori dan doktrin hukum dari para ahli hukum. Hasil dari penelitian ini dapat disimpulkan bahwa Penelitian normatif (doktrinal), yaitu penelitian terhadap hukum yang dikonsepkan dan dikembangkan atas dasar doktrin. Metode ini dimaknai sebagai penelitian hukum dalam tataran norma, kaidah, asas-asas, teori, filosofi, dan aturan hukum guna mencari solusi atau jawaban atas permasalahan baik dalam bentuk kekosongan hukum, konflik norma, atau kekaburan norma. Sedangkan Penelitian hukum empiris merupakan penelitian berkarakteristik non-doktrinal yang dilakukan melalui penelitian lapangan. Which means, it is a kind of a sign that the various legal regulations that normatively regulate the entire judicial process are ultimately unable to overcome the judicial corruption. The main objective of this research focuses on analysis related to efforts to revitalize the legal system in order to create an ideal rule of law as stated by Lawrance Friedman in his book namely "The Legal System: A Social Science Perspective". In this research, the method used is normative juridical using statutory, conceptual and historical approaches. The results of the research present an idea which is divided into three according to the three elements in the formation of a rule of law according to Lawrance Friedman, namely legal substance, legal structure, and legal culture. With regard to legal substance, the author provides the idea of a judicial preview as a method of validating the constitutionality of laws. Then related to the legal structure, the author provides ideas related to efforts to build morality and professionalism of law enforcement officials. Meanwhile, in terms of legal culture, the author provides ideas related to efforts to build a legal culture in society that is aware of the law and the constitution.

Non-court settlement disputes generally use different ways of dispute resolution through courts, ie, the use of several means among others is mediation in economic disputes. This paper discusses how the role of mediation as an alternative institution of dispute resolution to support national economic development and the role of the approach mufakat. This research uses nominal juridical method with analytical descriptive approach. The results of this study indicate that the role of mediation as an alternative institution of dispute resolution is important and some are not, especially in commercial court disputes; dispute that industrial relations courts; business competition; consumer disputes, and other disputes whose hearings in the hearing are determined by the deadline for settlement in the provisions of laws and regulations, such as disputes in banking and insurance. The approach of mufakat is very important in carrying out mediation of economic dispute resolution, because consensus is a symbol of the Indonesian nation.

This study aims to further analyze the weaknesses of the First to File principle, as well as to examine the extent to which the applicable legal system can protect legitimate trademark ownership, especially in the context of dispute resolution.

Perkembangan teknologi digital mendorong penggunaan kontrak elektronik dalam berbagai transaksi, yang memunculkan pertanyaan tentang keabsahan dan kekuatan mengikatnya secara hukum. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode analisis perundang-undangan, konseptual, dan komparatif. Hasil penelitian menunjukkan bahwa perjanjian elektronik memenuhi syarat sahnya perjanjian sebagaimana diatur dalam Pasal 1320 KUH Perdata, khususnya terkait kesepakatan, kecakapan hukum, objek tertentu, dan sebab yang halal. Selain itu, berdasarkan UU ITE, kontrak elektronik memiliki kekuatan hukum yang mengikat selama dibuat dengan sistem elektronik yang andal dan memenuhi prinsip transparansi dan akuntabilitas. Namun, dalam praktiknya masih ditemukan permasalahan hukum, terutama terkait pembuktian, autentikasi, dan mekanisme penyelesaian sengketa. Through this case analysis, this research highlights the importance of understanding the rights to recording masters and the strategies artists can use to regain control over their work, including re-recording their songs. The method used is a literature study, with an analysis of recording contracts, legal statements, and music industry publications. This research also examines how the media affects public perception and attitudes towards artist rights issues. Konsistensi dan koherensi antar peraturan perundang-undangan menjadi tolok ukur untuk menilai apakah suatu sistem hukum telah berjalan baik. Pada penelitian ini, pembahasan akan difokuskan pada tiga permasalahan, yaitu Pengaturan BPHTB dalam peraturan perundang-undangan Indonesia, Penyebab inkonsistensi pengaturan BPHTB dalam Peraturan Pemerintah Nomor 35 Tahun 2023 tentang Ketentuan Umum Pajak Daerah dan Retribusi Daerah, dan Pengaturan ideal BPHTB dalam tinjauan sistem hukum. Metode pendekatan dalam penelitian ini adalah metode pendekatan yuridis normatif, yang mengkaji norma hukum tertulis dari aspek sistem hukum. Spesifikasi penelitian yang digunakan adalah deskriptif analitis. Data yang digunakan dalam penelitian ini adalah data sekunder, dengan metode pengumpulan data berupa studi kepustakaan. Analisis data penelitian ini menggunakan analisis data kualitatif normatif. Hasil penelitian ini menunjukkan: 1). Pengaturan BPHTB dalam perundang-undangan Indonesia dimulai dengan Undang-Undang Nomor 21 Tahun 1997 tentang BPHTB hingga Peraturan Pemerintah Nomor 35 Tahun 2023, yang menjadi fokus bahasan penelitian ini. 2). Ketentuan Pasal 18 ayat (2) Peraturan Pemerintah Nomor 35 Tahun 2023 tidak konsisten dengan UUPA, Undang-Undang Hak Tanggungan, Peraturan Pemerintah tentang Pendataran Tanah, dan Peraturan Jabatan PPAT. 3). Pengaturan ideal BPHTB merupakan sintesis dari tiga aspek sebagaimana dicetuskan R.Mansury, yaitu Revenue Productivity, Equality/Equity, Ease of Administration. This research aims to analyze the monitoring and review of regional regulations to ensure the relevance, effectiveness, and harmonization of local legal products with the needs of the community and … This research aims to analyze the monitoring and review of regional regulations to ensure the relevance, effectiveness, and harmonization of local legal products with the needs of the community and the prevailing legal hierarchy. The absence of clear provisions regarding the mechanisms for monitoring and reviewing in Law No. 12 of 2011 concerning the Formation of Laws and Regulations hinders the realization of a harmonious and consistent legal system. This study employs a normative legal approach, analyzing theories of legal certainty, utility, legal systems, and legisprudence. The findings indicate that Law No. 12 of 2011 on the Formation of Laws and Regulations, as amended by Law No. 15 of 2019 and Law No. 13 of 2022, only regulates the monitoring and review of statutes (laws), without encompassing subordinate regulations, including Regional Regulations (Perda). The study reveals a legal vacuum regarding the mechanisms for monitoring and reviewing Perda, which leads to ambiguities in authority, procedures, and the implementation of evaluations across different levels of government. Consequently, the process is often conducted subjectively, without a uniform and systematic legal reference. To establish a regulatory model for the monitoring and review of Perda that ensures legal certainty, an integrated approach is required—one that combines normative juridical, evaluative-participatory, and data-based methodologies. In this context, three applicable models are identified: (1) a model that adopts the existing monitoring mechanism for statutes; (2) the Regulatory Impact Analysis (RIA) model; and (3) the ROCCIPI analysis model (Rule, Opportunity, Capacity, Communication, Interest, Process, and Ideology). Furthermore, the selective review approach within the Sunset Clause model may be integrated into both the RIA and ROCCIPI frameworks to strengthen the effectiveness of periodic and systematic evaluations of Perda.

This study aims to fill an academic gap by analyzing the regulation and practical use of DIM in the Rules of Procedure of provincial Regional People's Representative Councils (DPRD), a topic that has received limited attention in Indonesian legal literature. Using a normative legal approach and a descriptive-qualitative method, the study examines 14 provincial DPRD Rules of Procedure from 2024 and includes participatory observations conducted at the Jambi Provincial DPRD. The findings reveal that most DPRDs do not regulate the use of DIM-based deliberation for Ranperda. As a result, the legislative process is often ceremonial in nature, lacks public participation, and contributes to the low quality of regional legislation. The study recommends revising Government Regulation concerning the Formation of Regional Legal Products to make the use of DIM mandatory in Ranperda deliberations at the national level

However, this policy raises legal challenges when assets are in the hands of third parties acting in good faith. This study aims to explore the economic rights of such third parties and examine the legal protection of their rights during the seizure of assets derived from corruption. This study employs a normative juridical approach, utilizing statutory, conceptual, and case analyses. The findings reveal an imbalance between asset forfeiture policies and the principle of justice for third parties who acquire assets legally. Although regulations govern objections from good-faith third parties, practical implementation still faces difficulties in terms of proof and legal interpretation. Thus, this study suggests the need for more detailed regulatory reforms to ensure the fair protection of the economic rights of good-faith third parties while facilitating the recovery of state assets.

Salah satu alat yang efektif untuk tujuan ini adalah membentuk Lembaga Kerja Sama (LKS) Bipartit yang pada dasarnya berfungsi sebagai forum resmi untuk dialog dan negosiasi antara serikat pekerja dan pihak manajemen, guna mencapai kesepakatan mengenai berbagai isu ketenagakerjaan. Masalah utama yang dihadapi SP Yogyakarta ini adalah belum terbentuknya LKS Bipartit karena adanya keraguan dari pihak manajemen perusahaan. Sehingga, tujuan kegiatan PKM ini adalah untuk mendampingi SP merancang dan membentuk LKS Bipartit serta mengadakan pelatihan agar SP dapat meyakinkan manajemen perusahaan untuk mencapai kesepakatan bersama. Metode yang digunakan adalah workshop untuk memulai proses pembentukan LKS Bipartit, dengan peserta sebanyak 30 anggota serikat pekerja pada bulan Juli 2024, di Surakarta. Hasil kegiatan PKM ini adalah (1) peningkatan pemahanan pengurus dan anggota terhadap LKS Bipartit dengan memberikan materi yang memperkenalkan LKS Bipartit. This development presents significant legal challenges in the field of copyright protection, particularly concerning the determination of authorship and whether such works satisfy the originality requirement as mandated by prevailing copyright law. This study aims to analyze and evaluate the legal protection afforded to AI-generated works within the framework of Indonesian Intellectual Property Law, with specific reference to Law No. 28 of 2014 on Copyright and relevant international principles under the TRIPs Agreement. This research employs a normative juridical approach using statutory analysis and doctrinal examination of legal literature, statutory provisions, and contemporary legal theories. The findings indicate that the current Indonesian legal system does not explicitly accommodate the legal status of AI-generated works, thereby creating a potential legal vacuum and uncertainty in copyright protection. The study recommends a reformulation of copyright regulation to include recognition of human contribution in the creative process of AI-generated works (human authorship model) as a fundamental basis for copyright entitlement. Adapting the legal framework is essential to maintain a balance between the protection of creative works, the promotion of technological innovation, and the assurance of legal certainty within the Intellectual Property ecosystem in the digital era.

Prolematik ini berlaku bagi aparat penegak hukum khususnya hakim dalam mewujudkan putusan yang memenuhi keadilan hukum, keadilan moral dan keadilan sosial. Undang-Undang Tindak Pidana Kekerasan Seksual (UU TPKS) menambahkan jenis alat bukti dalam pengungkapan kasus kekerasan seksual dari sebelumnya hanya ada 5 (lima) jenis sesuai yang diatur dalam Pasal 184 KUHAP. Kedua pembaharuan jenis tindak pidana dalam perspektif UU TPKS dalam memberikan jaminan kepastian hukum bagi pemenuhan keadilan korban?, Kedua ,Sejauhmana implikasi yuridis Pendekatan dalam penelitian ini adalah pendekatan Yuridis Normatif, dengan sumber data adalah KUHAP, KUHP, UUTPKS, Naskah Akademis RUU Penghapusan Kekerasan Seksual dan sumber-sumber lain yang relevan. Hasil penelitian menunjukan Hasil penelitian Pertama menunjukan Pembuktian dalam UU TPKS telah membawa dampak bagi pemenuhan keadilan bagi Korban hal ini dapat dilihat dengan diperluasnya alat bukti tindak pidana kekerasan seksual yang diatur dalam Pasal 24 dan 25 UU TPKS antara lain: barang bukti dapat berfungsi sebagai alat bukti, informasi/dokumen elektronik, termasuk alat bukti adalah hasil pemeriksaan psikolog klinis, hasil pemeriksan forensik dan rekam medis. Perluasan alat bukti juga diharapkan mempermudah proses hukum kasus-kasus tindak pidana kekerasan seksual yang dillaporkan oleh korban. Karena tindak pidana kekerasan seksual ummnya terjadi di ranah privat dimana hanya melibatkan pelaku dan korban. Kedua, pembaharuan jenis Tindak Pidana Kekerasan Seksual dalam perspektif UU TPKS memberikan jaminan kepastian hukum bagi pemenuhan keadilan korban yang terdiri dari 9 jenis TPKS: pelelecehan seksual non fisik, pelecehan seksual fisik, pelecehan kontrasepsi, pemaksaan perkawianan, penyiksaan seksual, eksploitasi seksual, perbudakan seksual, pemaksaan perkawinan dan kekerasan seksual berbasil elektronik. Semua diatur dalam Pasal 4. Sampai dengan Pasal 14 UU TPKS.Diharapkan pembentukan regulasi di lingkungan Aparat Penegak Hukuk (Kepolisian, Kejaksaan, Kehakiman dan Lembaga Pemasyarakatan) terkait pembuktian.

The Indonesian National Police as one of the law enforcement institutions has a strategic role in realizing a legal system that is not only based on normative legality, but also upholds the values of humanity, morality, and social justice. In this context, the progressive legal approach introduced by Satjipto Rahardjo is very relevant to be adopted and implemented by the Indonesian National Police. Progressive law offers a new paradigm in law enforcement that sides with the people, rejects procedural rigidity, and prioritizes humanitarian values as the substance of law. This study aims to normatively examine the concept of progressive law about the role and function of the Indonesian National Police and to formulate strategies that can be used to strengthen the implementation of the progressive legal approach within the Indonesian National Police. This study uses a normative juridical method, with a statutory regulatory approach and a conceptual approach. The legal materials used consist of primary legal materials such as the 1945 Constitution of the Republic of Indonesia, Law Number 2 of 2002 concerning the Indonesian National Police, and other related regulations. In addition, secondary legal materials are also used in the form of legal literature, scientific journals, and the views of legal experts on progressive law. This study is expected to provide theoretical contributions to the development of progressive legal discourse and provide a conceptual basis for institutional renewal within the National Police to create just and humanistic law enforcement.

The dispute arose … This study examines the application of Private International Law (PIL) in resolving cross-border trademark disputes, focusing on the case of IKEA Sweden versus PT Ratania Khatulistiwa Indonesia. The dispute arose due to differing legal principles: Indonesia’s legal system adheres to the first to file principle, while international systems recognize the first use principle and the protection of well-known trademarks. The Supreme Court of the Republic of Indonesia ruled in favor of the domestic party, concluding that IKEA Sweden did not meet the criteria for active use of the trademark in Indonesia. This study employs a normative legal approach using a descriptive-analytical method through literature review. The analysis is based on primary, secondary, and tertiary legal materials and incorporates statutory, conceptual, and case approaches, encompassing the principles of jurisdiction, choice of law, and recognition and enforcement of foreign judgments. The findings reveal that the Indonesian legal system has not fully accommodated PIL principles, particularly regarding the protection of well-known trademarks. The lack of harmony between the principle of good faith and the principle of territoriality has resulted in legal uncertainty, especially for foreign investors. Moreover, the recognition and enforcement mechanism for foreign judgments remains ineffective, potentially leading to conflicting rulings in multi-forum litigation. This study concludes that reformulating the national legal system in alignment with PIL principles and international standards is crucial to enhancing trademark protection and fostering legal certainty in support of a globally competitive investment climate.

A normative juridical method was employed to address the issue of electronic contract validity, which remains a primary challenge amid the rapid advancement of technology and the digitalization of transactions. A key factor influencing this validity is the public’s limited understanding of the legal aspects of digital contracts. In today’s digital era, e-commerce transactions have become increasingly dominant, with electronic contracts serving as the principal instruments in conducting online business activities. This study analyzes essential aspects of the legality of electronic contracts, including consent and electronic signatures, party identification, consumer protection, and dispute resolution mechanisms. The findings reveal that although the UU ITE provides a strong legal foundation, there is a continued need for legal education, regulatory refinement, and the strengthening of dispute resolution systems to ensure the lawful and effective implementation of electronic contracts. The study underscores the importance of compliance with legal requirements in digital transactions and the role of the UU ITE in safeguarding the legality and credibility of Indonesia’s e-commerce system. The implications support the reinforcement of the national legal framework to promote sustainable and trustworthy growth in digital transactions.

The legal issue raised is the discrepancy between das sein (the reality on the ground) and das sollen (the legal provisions that should apply). In the Malang Raya region, these provisions are often overlooked or not implemented as they should be, resulting in numerous disputes over land and buildings based on PPJB and lease agreements. This study employs an empirical method grounded in theories of legal effectiveness, legal certainty, and legal utility. The results of the study indicate that the implementation of Article 127B has been ineffective because the three indicators of legal effectiveness—legal Substance, legal Structure, and legal culture—have not been met. The primary causes are the inadequate enforcement of regulations and a lack of understanding among relevant parties regarding the registration mechanism. Therefore, technical guidelines, as well as socialization and training, are necessary to enhance the effectiveness of implementing this article and prevent disputes in the future.

The provisions in articles 110A and 110B provide administrative options for companies that have opened plantations in forest areas, namely by applying for legalization and paying administrative fines. However, Presidential Regulation Number 5 of 2025 introduces stricter sanctions in the form of land takeovers by the state without going through the administrative process regulated in the law, thus giving rise to a conflict of norms. The purpose of this study is to critically examine the contradictions between the two regulations and evaluate their impact on the legal principles of state administration, especially in the context of legal certainty and legal protection for business actors. The research method used is a normative-juridical approach through literature study and comparative analysis of relevant laws and regulations, as well as a review of administrative legal theories. The study reveals a fundamental inconsistency between the Labour Creation Law, which prioritizes administrative resolution, and Presidential Regulation 5/2025, which imposes direct land takeovers without due administrative process. This disparity creates legal uncertainty, undermines the principle of legality, and threatens the investment climate in the plantation sector. Regulatory harmonization and broad policy dissemination are needed to ensure alignment with the rule of law and promote justice for all stakeholders.

This approach … The rehabilitation of individuals struggling with addiction to narcotics, as outlined in Law No. 35/2009, underscores a two-pronged strategy that prioritises the recovery of health and social reintegration. This approach eschews criminal retribution in favour of more holistic methods of addressing the issue. The concept of restorative justice has emerged as an alternative approach to narcotics crime resolution, emphasising the recovery of offenders, victims and communities through dialogue and deliberation, rather than punishment. However, this approach is not without its challenges, and as such, the establishment of a robust legal framework is paramount. This research aims to integrate the concept and principles of restorative justice in the handling of narcotics abuse cases in Law No. 35/2009 based on the principle of justice and examine the legal reform of the application of restorative justice in the settlement of narcotics offences. The research method employed is a normative research method through a legislative approach and analytical approach. The results obtained demonstrated that the concepts and principles of restorative justice can be integrated in handling narcotics abuse cases based on Law No. 35/2009 to realise the principle of justice. The fundamental tenet of restorative justice emphasises the rehabilitation of individuals who use narcotics as a means of recovery, superseding the mere imposition of punishment. It is therefore imperative that a comprehensive revision of Law No. 35/2009 is made in order to incorporate the restorative justice approach on a more extensive scale.

However, this technological evolution has exposed unprecedented civil liability risks that surpass the governance capacity of conventional traffic legal frameworks. This urgency calls for establishing a systematic legal governance framework focused on liability allocation rules, designed to address the unique challenges of civil liability risks in autonomous driving systems. This paper systematically examines international and domestic autonomous vehicle classification standards alongside Chinese current legislative landscape governing autonomous vehicle technologies. It analyses accountability dilemmas arising from human-machine shared control in advanced driving assistance system, progressing to imputation challenges triggered by the full delegation of operational control in autonomous driving systems. To address distinct technological phases, we propose a layered governance model: for driver-assist vehicles, a technical intervention audit mechanism under the fault liability framework; for autonomous vehicles, a tripartite liability hierarchy involving end-users, owners, and manufacturers.

In this context, game theory serves as an analytical framework to map strategic interactions between business actors, particularly in cases involving collusion, cartels, and other anti-competitive behaviors. This study explores the extent to which game theory has been implemented in Indonesia’s competition law enforcement, covering the investigation, evidence-gathering, and decision-making processes. By using a normative and juridical-empirical approach, this study reveals a gap between the theoretical potential of game theory and its limited practical application due to regulatory constraints, institutional capacity, and lack of technical expertise among law enforcers. The findings emphasize the importance of aligning economic theory with legal instruments to improve the effectiveness of competition law enforcement. As a strategic recommendation, the study suggests strengthening institutional capabilities through specialized training, issuing technical guidelines on economic analysis, enhancing data transparency, and promoting stronger collaboration between regulators and academia to ensure broader integration of game theory in practice.

Law No. 22 of 2004 on the Judicial Commission was enacted to fulfill this mandate, as amended by Law No. 18 of 2011 on Amendments to Law No. 22 of 2004 on the Judicial Commission. To exercise its authority, namely to uphold and maintain the honor, dignity, and conduct of judges, the Judicial Commission adheres to the Code of Ethics and/or Guidelines for Judicial Conduct (KEPPH). In practice, the judge considers the decision of the Palu District Court Number 102/Pdt.G/2022/PN Pal. jo. the Decision of the Central Sulawesi High Court No. 29/PDT/2023/PT PAL, which was based on evidence that the Plaintiff never submitted during the trial. This research aims to deepen knowledge regarding the legal consequences for judges who fail to include evidence in court proceedings and to identify and determine the concept of judicial negligence in rendering a decision without including evidence in the court proceedings. The results of the study indicate that the actions of the Panel of Judges in the decision are contrary to Article 53 of Law No. 48 of 2009 on Judicial Power, which states that a decision must contain the judge's legal considerations based on proper and correct reasons and legal grounds. Number 10 jo. Article 14 of the KEPPH also stipulates that judges must be professional and avoid errors in their decisions. Judges are also bound by the 2002 Bangalore Basic Principles, namely independence, neutrality of the judiciary, and integrity of judges. The Judicial Commission is authorized to enforce the KEPPH by proposing sanctions against the judges concerned, considering several factors, namely the existence of indications, evidence, intentional elements, and the decision's impact containing the judge's error. Judges are also bound by the 2002 Bangalore Principles, namely independence, neutrality of the judicial institution, and judicial integrity.

Initially introduced through Law No. 11 of 2012 concerning the Juvenile Criminal Justice System, restorative justice emphasizes the involvement of victims, offenders, and the community in resolving criminal cases with a focus on restoration rather than retribution. Although its application has gradually expanded to adult offenders, it remains partially regulated and lacks a comprehensive statutory foundation. This paper applies a qualitative method using a normative juridical and descriptive-analytic approach, based on legal materials, statutory provisions, and institutional regulations. The findings reveal that restorative justice in Indonesia has not yet been codified into a single unified law. Instead, its practice is fragmented across various institutional regulations, such as those issued by the Indonesian National Police, the Attorney General's Office, and the Supreme Court. The study highlights several issues, including the inconsistent application of restorative justice, the persistence of retributive legal culture among victims, and the urgent need to reduce prison overcrowding. It argues that restorative justice offers an effective alternative to imprisonment by promoting conflict resolution, victim-offender reconciliation, and community-based justice. The incorporation of restorative justice into Indonesia’s Draft Criminal Code and institutional frameworks signifies a growing shift toward legal modernization, social justice, and the realization of Pancasila-based values in the national penal system.

With its ability to analyze big data and detect complex patterns, AI has the potential to improve the efficiency and effectiveness of law enforcement. This article will discuss the role of AI in improving the efficiency of the legal system as well as the challenges faced in its implementation. This article aims to explore how AI technology can be integrated into legal practice to speed up the decision-making process, reduce operational costs, and improve the accessibility of legal services. The writing of this article uses a qualitative approach, with data collection methods through desk study, the legal sources used are primary, secondary and tertiary legal sources. The results show that artificial intelligence has an important role to play in improving the efficiency of the legal system through big data analysis, automation of legal processes, and offense detection. However, despite its significant benefits, ethical and regulatory challenges related to the use of AI in the legal system also need to be addressed. Issues such as data privacy and algorithmic bias must be addressed so that the implementation of these technologies does not disadvantage certain parties. With the right strategy and collaboration between the government and the private sector, AI can be an innovative tool to improve the legal ecosystem in the future. Overall, artificial intelligence has great potential to revolutionize the legal system by improving operational efficiency and service accessibility. Further research is needed to fully understand the long-term impact of integrating this technology in legal practice.

As a crucial … This study examines the role of the Administrative Court (Pengadilan Tata Usaha Negara - PTUN) in resolving administrative disputes in Indonesia through a systematic literature review approach. As a crucial pillar within the Indonesian judicial system, PTUN plays a strategic function in maintaining the balance of power between the government and its citizens through independent judicial control mechanisms. This research analyzes the effectiveness of PTUN in providing legal protection for citizens' rights against arbitrary administrative actions and evaluates the implementation of general principles of good governance in administrative judicial practice. The findings indicate that PTUN has significantly contributed to upholding the principles of the rule of law and promoting accountable governance, despite facing several challenges in its implementation. These challenges encompass structural aspects including limitations in human resources and infrastructure, procedural challenges related to the complexity of procedural law, and substantial challenges regarding consistency in legal interpretation and judgment execution. Comparative analysis with international administrative court systems provides valuable insights into best practices that can be adapted within the Indonesian context. This study recommends strengthening institutional capacity through human resource development and infrastructure modernization, simplifying procedural mechanisms, harmonizing legal interpretation, and enhancing public accessibility to administrative judicial services to optimize PTUN's role in strengthening the rule of law in Indonesia.

The purpose of this study is to examine how the responsibility of business actors for the products sold and analyze whether the responsibilities of business actors are in accordance with statutory regulations, especially Law Number 8 of 1999 concerning Consumer Protection. The research method used is normative legal research, with a case approach and legislative approach. Research data is obtained from primary legal sources in the form of laws and regulations, doctrine, scientific literature, and the results of relevant academic studies. The results showed that business actors have carried out their obligations by providing after-sales service in the form of unit repairs. However, in this case, it was found that many consumers experienced the same damage, so the business actor should take another step, namely recall the product from distribution.

Latar belakang penelitian ini menyoroti peran OJK dalam mengatur dan mengawasi kegiatan jasa keuangan untuk mewujudkan sistem keuangan yang adil, transparan, dan akuntabel. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, konsep, dan filsafat hukum. Hasil penelitian menunjukkan bahwa efektivitas sanksi denda dipertanyakan karena beberapa faktor, termasuk kondisi keuangan pelanggar dan besarnya nominal sanksi. Studi kasus PT Garuda Indonesia (2018) menggambarkan bahwa sanksi administratif belum memberikan efek jera yang memadai dibandingkan dengan kerugian yang dialami investor. Kesimpulannya, penelitian ini menekankan perlunya mekanisme sanksi yang lebih tegas dan preventif agar dapat meningkatkan kepatuhan pelaku pasar modal dan melindungi kepentingan investor.

Tesis ini, menggunakan metode penelitian hukum normatif (kepustakaan) dengan mengumpulkan data sekunder dan dianalisis secara kualitatif untuk mendapatkan kesimpulan tentang Pihak Penghadap bisa gagal memperoleh Salinan akta PPJB disebabkan karena kelalaian atau kesengajaan notaris yang belum menandatangani minuta akta bersama penghadap, saksi, dan penerjemah resmi dalam membuat akta PPJB. Pembatalan pemberhentian Notaris dengan tidak hormat dapat kembali memiliki kewenangan sebagai Notaris apabila melakukan upaya hukum gugatan pembatalan Surat Keputusan Kemenkumham pemberhentian dengan tidak hormat tersebut melalui PTUN. Apabila, Putusan Majelis Hakim PTUN menyatakan batal demi hukum, secara tidak langsung mengembalikan notaris sesuai profesi jabatannya serta mengembalikan harkat dan martabat notaris kepada keadaan semula.

Keberadaan Danantara menunjukkan pergeseran arah politik hukum perekonomian dari paradigma negara kesejahteraan menuju negara pasar yang menekankan efisiensi dan optimalisasi aset. Penelitian ini bertujuan untuk menganalisis arah politik hukum perekonomian Indonesia dan mengkaji peran advokat dalam mengawal reformasi ekonomi melalui pendekatan filsafat hukum dan teori peran advokat. Menggunakan metode yuridis-filosofis dan pendekatan perbandingan, penelitian ini membandingkan Danantara dengan tiga model SWF global: Temasek Holdings (Singapura), Mubadala (UEA), dan Norwegian Government Pension Fund Global (Norwegia). Hasil penelitian menunjukkan bahwa Indonesia masih menghadapi dilema antara kepentingan publik dan dominasi kekuasaan ekonomi elit. Di sisi lain, advokat memiliki peran strategis sebagai pengawal supremasi hukum, partisipasi publik, dan keadilan ekonomi. Penelitian ini menegaskan urgensi reformulasi desain hukum dan pelembagaan partisipatif dalam pengelolaan kekayaan negara untuk memastikan bahwa arah reformasi ekonomi tidak menyimpang dari semangat konstitusi dan keadilan sosial.

Findings reveal that Malaysia, through Bank Negara Malaysia (BNM), offers a more unified and comprehensive regulatory system, while Indonesia's model involves multiple institutions with overlapping mandates. This article contributes to understanding the legal challenges of digital Sharia banking and proposes regulatory harmonization, stronger digital safeguards, and a greater role for Sharia supervisory bodies. The study is limited to legal documents; future research may include an empirical assessment of consumer protection outcomes.

In order to achieve a fair … The study is to examine, from the standpoint of legal advantages, the regulation and application of restorative justice in addressing domestic violence (DV) cases. In order to achieve a fair and beneficial conclusion, restorative justice places a strong emphasis on victim recovery, offender accountability, and community involvement. This study examines laws that support the implementation of restorative justice, such as Police Regulation Number 8 of 2021 and Prosecutor's Regulation Number 15 of 2020, and their applicability to the protection of domestic violence victims using a normative legal method that combines a statute approach and a conceptual approach. The study's findings suggest that a different approach to DV case resolution may be restorative justice, especially in ongoing social relationships, such as husband-wife or parent-child, so that it can reduce the negative impact of conventional criminalization on families, including social and economic aspects. However, its application must be carried out selectively, considering the risk of pressure on victims to reconcile and the potential for the recurrence of violence. From the perspective of legal benefits, restorative justice implementation can provide broader benefits compared to the retributive punishment system, provided that there is strict supervision and a mechanism that ensures that justice for victims remains a top priority. Therefore, evaluation and strengthening of regulations are needed to ensure that the implementation of restorative justice in domestic violence cases truly provides legal protection and benefits for all parties involved.

Analisis norma dan putusan menunjukkan adanya ketidakjelasan pengaturan, namun didapati bahwa penahanan dapat membatasi kewenangan Notaris. Disimpulkan, diperlukan regulasi yang lebih tegas terkait pelaksanaan tugas jabatan Notaris selama menjalani penahanan rumah atau kota untuk menjaga kepastian hukum dan keadilan.

These regulatory changes include simplifying … The revision of the Job Creation Law through Law Number 6 of 2023 aims to improve the investment climate and protection of workers in Indonesia. These regulatory changes include simplifying business licensing through the Online Single Submission (OSS) system, implementing risk-based licensing, and incentivizing investors to attract more domestic and foreign investment. From the employment aspect, this revision introduces adjustments to the minimum wage formula, restrictions on the outsourcing sector, changes to severance pay provisions, and more structured termination of employment (PHK) procedures. The Job Loss Guarantee (JKP) program is delivered as additional protection for laid-off workers. Although this policy provides legal certainty and flexibility for the business world, the main challenges in its implementation are the supervision of company compliance, the effectiveness of labor protection, and the readiness of the bureaucracy to implement a more transparent system. With a normative legal approach through regulatory analysis, this study highlights the impact of changes to the Job Creation Law on investment and employment. It provides recommendations to strengthen supervision, socialization, and collaboration between the government, the business world, and workers. The policy is expected to create a competitive investment environment, improve worker welfare, and encourage inclusive and sustainable economic growth in Indonesia.

This study aims to analyze the role of law in upholding social justice for victims of corruption by examining the available rehabilitation mechanisms within Indonesia’s legal framework. It also explores the regulatory limitations and challenges in implementing legal protection for corruption victims. This research employs a normative juridical method, utilizing both a statute approach and a conceptual approach. The statute approach involves an analysis of various regulations related to corruption and victim protection, For example, Law No. 13 of 2006 in connection with Law No. 31 of 2014 on the Protection of Witnesses and Victims, and Law No. 31 of 1999 in connection with Law No. 20 of 2001 on the Eradication of Corruption Crimes. In the meantime, the conceptual approach investigates social justice themes such as restitution that are connected to the restoration of the rights of victims of corruption, compensation, and rehabilitation as recognized in both national and international law. The results of this study are expected to contribute to the development of legal policies that are more victim-oriented and to strengthen the implementation of social justice within the criminal justice system. With effective legal mechanisms in place, it is hoped that the recovery of corruption victims can be optimized as part of a more comprehensive anti-corruption strategy.
This study examines the implementation of legal protection for persons with disabilities in the process of executing authentic deeds before a notary with a particular focus on the alignment between … This study examines the implementation of legal protection for persons with disabilities in the process of executing authentic deeds before a notary with a particular focus on the alignment between actual practice and the provisions stipulated in Law No. 2 of 2014 concerning the Position of Notary and Law No. 8 of 2016 on Persons with Disabilities. Employing a normative and empirical juridical approach, this research combines legal literature analysis with field data gathered through interviews involving notaries, persons with disabilities, and disability advocacy organizations. The findings reveal several structural and practical barriers that hinder the full realization of legal rights for persons with disabilities in notarial services. These include the limited availability of sign language interpreters, the absence of Braille-format legal documents, the lack of physical accessibility in notary offices, and low awareness among notaries regarding inclusive service principles. Consequently, persons with disabilities are vulnerable to indirect legal discrimination and often do not receive equal legal protection. This study recommends strengthening technical regulations, providing disability-friendly infrastructure in notary offices, and offering specialized training on inclusive services for notaries. In doing so, the notarial service system can be transformed into one that ensures equality of rights and effectively accommodates the needs of all citizens, in accordance with the principles of social justice and human rights. Bahasa Indonesia Abstract: Penelitian ini membahas implementasi perlindungan hukum bagi penyandang disabilitas dalam proses pembuatan akta autentik di hadapan notaris dengan menitikberatkan pada kesesuaian praktik di lapangan terhadap ketentuan dalam Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris serta Undang-Undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas. Penelitian ini menggunakan pendekatan yuridis empiris yang mengombinasikan studi literatur hukum dengan hasil wawancara terhadap notaris, penyandang disabilitas, dan lembaga pendamping disabilitas. Temuan penelitian menunjukkan bahwa terdapat berbagai hambatan struktural dan praktis yang menghambat pemenuhan hak penyandang disabilitas dalam layanan kenotariatan. Hambatan tersebut antara lain mencakup minimnya ketersediaan Juru Bahasa Isyarat (JBI), absennya dokumen Braille untuk tunanetra, kurangnya sarana fisik yang aksesibel di kantor notaris, serta rendahnya kesadaran dan pemahaman notaris terkait prinsip inklusivitas. Akibatnya, penyandang disabilitas rentan mengalami diskriminasi hukum secara tidak langsung dan tidak memperoleh perlindungan hukum yang setara. Penelitian ini merekomendasikan adanya penguatan regulasi teknis, penyediaan fasilitas ramah disabilitas di kantor notaris, serta pelatihan khusus mengenai pelayanan inklusif bagi para notaris. Dengan demikian, diharapkan tercipta sistem layanan kenotariatan yang menjamin kesetaraan hak dan mampu mengakomodasi kebutuhan seluruh warga negara tanpa terkecuali, sesuai dengan prinsip keadilan sosial dan hak asasi manusia.

Executive dominance … This journal examines the abuse of executive power within Indonesia’s constitutional system, particularly focusing on the imbalance of power distribution that undermines the principle of checks and balances. Executive dominance frequently leads to deviations such as corruption, interference in judicial processes, and the weakening of oversight institutions as well as the weakening of supervisory institutions which has an impact on weakening the supremacy of law and democratic values. This research uses a literature review method to analyze the mechanisms of oversight and accountability of executive power, as well as the impact on the rule of law, democracy, and social life. The findings show that both internal and external oversight—conducted by the legislature, judiciary, independent institutions, and civil society—still face challenges in terms of regarding effectiveness and independence. The abuse of power contributes to the erosion of legal supremacy, the restriction of civil space, and the emergence of covert authoritarian governance. Therefore, institutional reform, strengthening oversight functions, and increasing public participation are essential to building a democratic, transparent, and accountable system of government

This study analyzes the case of Decision … Police officers' culpa in carrying out their duties has a serious impact on the justice system and the accountability of the police institution. This study analyzes the case of Decision No. 55/Pid.B/2024/PN Plk to evaluate the legal process in dealing with the culpa of officers that led to death and serious injury. The results showed that the lenient verdict against the defendant did not reflect substantive justice and created a crisis of public confidence in the legal system. Lack of transparency in investigations and weak regulations on the use of force in the police force exacerbate this situation. Inequality in law enforcement between officers and civilians exacerbates injustice in the criminal justice system. In recent years, a number of cases involving members of the police as perpetrators of crimes, especially those related to violence, have reduced the positive image of the police in the eyes of the public. One of the most prominent cases was a shooting committed by a police officer in Palangkaraya, Central Kalimantan, which involved culpa and abuse of authority. From 2023 to 2025, two shooting incidents involving members of the National Police occurred in this region, with most of the victims being civilians. These cases illustrate not only individual errors in the performance of duties, but also weaknesses in POLRI's internal control system. These shootings by police officers raise questions about causal factors, such as culpa in supervision, abuse of authority, mental health problems, and inability to manage emotions under pressure. Therefore, reforms in oversight mechanisms, increased transparency in the judiciary, and strengthened regulations related to police accountability are needed to ensure fairer law enforcement. In addition, protection for victims must be strengthened so that justice is not only oriented towards the perpetrators but also towards the rights of victims and their families. Legal reforms should include improvements to police operational standards so that the use of force remains in accordance with the principles of human rights and the rule of law. These reforms are expected to make the criminal justice system more effective in enforcing the law fairly and increase public confidence in the police institution.

Globalization and increasing labor mobility across countries necessitate effective regulations and comprehensive policies to protect migrant workers from exploitation and legal uncertainties. This article examines international labor policies implemented by various countries and international organizations such as the International Labour Organization (ILO) and the strategic role of labor attachés in enforcing protection for migrant workers. The research employs a policy analysis method with a descriptive-qualitative approach based on literature reviews and secondary data. The findings indicate that international labor policies still face challenges in regulatory harmonization between countries, compliance with labor standards, and the effectiveness of law enforcement mechanisms. The role of labor attachés as government representatives in providing protection, advocacy, and legal assistance for migrant workers is a key factor in ensuring optimal policy implementation. This study concludes that coordination between labor-sending and receiving countries, strengthening the capacity of labor attachés, and enhancing international cooperation are essential to establishing a more effective and sustainable protection system for migrant workers.

The principle of Hak Menguasai Negara (State’s Right to Control) grants the state comprehensive authority over mining activities, including policy-making, licensing, and supervision. However, decentralization policies have shifted the balance of power between central and regional governments. This paper analyzes the legal and policy frameworks governing this division of authority, focusing on the role of local governments. Employing normative legal research through the examination of statutes and legal principles, the research finds that the centralization of mining permits under Law No. 3 of 2020 has significantly diminished local governments’ authority, resulting in governance inefficiencies and economic imbalances. The paper further explores asymmetric decentralization as a potential approach to harmonize state control with meaningful local government participation.
